At the Area Court Grade II Ajaja, respondent sought an order to restrain the appellant from trespassing on land in dispute between the parties.

The court admitted judgements in suits between the deceased brothers of the parties and the court awarded ownership of the land to the respondent.

Appellant went to the High Court which allowed the appeal.

Respondent appealed to the Court of Appeal which allowed his appeal and ordered a retrial.

Appellant appealed to the Supreme Court.
